Terms for website use, orders, payments, collection, reservations and The Gay Baker services.
1. About this website
thegaybakershop.com presents The Gay Baker menu, experiences, whole cakes, locations and services. The website is not currently an ecommerce checkout: submitting a website request or starting a WhatsApp conversation does not by itself create a confirmed order.
2. Legal operators by location

3. Prices, availability and confirmation
We aim to keep prices, opening hours and catalogue information current. Availability may change because of production, operating capacity, ingredients, stock or events. A request is not automatically accepted. An order is confirmed only when The Gay Baker expressly confirms the product, total price, collection location, date and time and, where applicable, the requested payment or deposit has been received.
If we cannot serve the requested date or time because of order volume, product availability or another operational need, we may decline the request or propose an alternative before confirming the order.
4. Whole Cake orders
Whole Cake orders can be requested through WhatsApp or in store and require a minimum of 48 hours’ notice. Shorter notice is accepted only where the store expressly authorises it and confirms that production and collection can be accommodated.
Payment is coordinated with the chosen location and may be made using the payment methods communicated to the customer, including payment links where available. The product, amount and principal order conditions are confirmed before payment.
5. Collection, transport and storage
Once an order has been confirmed, the customer is responsible for collecting it from the agreed location at the agreed date and time. If you expect to be late, contact the store as soon as possible. Because cakes are perishable, The Gay Baker cannot guarantee the same product quality where collection is significantly delayed beyond the agreed time.
Once a product has been handed over in accordance with the order, transport and appropriate storage become the customer’s responsibility. We recommend transporting cakes in a car or taxi on a flat surface, avoiding motorcycles and keeping them refrigerated as instructed. This does not restrict statutory rights concerning a defect, non-conformity or failure that already existed at handover.
6. Changes, cancellations and our inability to fulfil
Change and cancellation requests are considered according to the notice given and the stage of production. Once preparation, specific ingredient purchasing or personalisation has begun, cancellation or refund options may be limited in relation to work or materials already committed, without restricting mandatory consumer rights.
If The Gay Baker cannot fulfil a confirmed, paid order for a reason attributable to us, we will coordinate a reasonable alternative — such as another date or product — or the appropriate refund.
7. Handmade products and allergens
Our products are handmade, so reasonable variations in finish, colour, shape or decoration can occur without changing the essential characteristics of the product ordered. Customers should tell us about allergies or dietary restrictions before confirming an order. We can provide information about ingredients and our normal processes, but we will not describe an item as allergen-free unless we can expressly guarantee that.
8. Afternoon Tea
The current price is S/65 per person with a minimum of two guests. Surquillo requires a reservation; Miraflores may have walk-in availability depending on operations, although we recommend checking. A 50% deposit is normally requested.
Bookings can normally be moved up to the day before when preparation has not yet taken place. A same-day change to another date carries an additional S/20 per person. Within three hours of the booking, or in the event of a no-show, the deposit is lost. These conditions do not limit statutory consumer rights where the service cannot be provided for reasons attributable to the provider or there is a failure to provide the agreed service.
9. Corporate, catering and events
Catering, corporate Afternoon Tea, gifts, activations, volume orders, private rooms and venue hire are quoted case by case. A WhatsApp or email conversation starts an enquiry but is not itself a booking or contract; scope, price, date, capacity, payments and conditions are confirmed separately.
10. Newsletter promotion — 15% Whole Cakes
For new subscribers who expressly consent to receive The Gay Baker marketing emails and confirm their address through Kit’s double opt-in process. Each code is individual, single-use and gives 15% off the subscriber’s first regular-catalogue Whole Cake. It cannot be combined with another promotion or discount, has no cash value and cannot be reused.
The order must be placed and confirmed by 15 October 2026 and collection must take place by 31 October 2026. The standard 48-hour notice rule applies; shorter notice requires express store authorisation. All orders remain subject to product availability and operational capacity for the requested collection date and time.
Minimum promotional availability: 100 promotional uses. The promotion may continue above this number throughout its stated period; this figure is not a maximum cap on the orders or codes The Gay Baker may accept.
The code is issued when signup is requested but can be redeemed only after Kit confirms the subscription. Redemption is recorded when the order is confirmed. Responsibility for attending collection remains with the person placing the order.
11. Intellectual property
The Gay Baker brand, owned photography, text and visual assets may not be reused commercially without permission. Third-party marks mentioned on the site remain the property of their respective owners.
12. Contact and complaints
