Privacy Policy
How The Gay Baker handles information you share with us and website privacy choices.

1. Controllers and scope
This policy applies to thegaybakershop.com. The controller for information relating to your enquiry, order, booking or event is the company operating the relevant location: Chicha Exports S.A.C., RUC 20608659189, Santa Rosa 147, Surquillo 15047, Lima, for Surquillo; and London Foods S.A.C., RUC 20615516890, Calle Bellavista 538, Miraflores 15074, Lima, for Miraflores.
For the email list, newsletter, marketing preferences and welcome promotion, the personal-data-bank controller is Chicha Exports S.A.C., at Santa Rosa 147, Surquillo 15047, Lima. The data bank is registered with Peru’s National Personal Data Protection Register under code INS-2026-5109.
2. Data we handle
Depending on how you use the site, we may handle information you provide directly, such as name, email, phone, order or booking details, chosen location and information included in a consumer complaint. Hosting systems may also create technical logs required for security and operation.
If you voluntarily subscribe to the newsletter, we collect your email and marketing consent. We also keep the date and version of your consent, the signup page and, where relevant, the promotional-code identifier. Records used to check promotion use and prevent duplicates limit exposure of your email address.
We temporarily use technical connection data to protect forms and staff access against abusive attempts. We do not use it for advertising or tracking you across websites.
3. Purposes and consent
We use necessary information to answer enquiries, manage orders, bookings, events, coordinated payments, complaints, security and legal obligations. An ordinary enquiry, order or WhatsApp message is not automatically treated as marketing consent.
Marketing emails, news, products, events and promotions are sent only after express consent. You can withdraw it through the unsubscribe link in an email or by writing to info@thegaybakershop.com. The 15% promotion is a voluntary signup benefit and does not condition ordinary access to products or services.
In the celebrations and corporate enquiry form, we use your name, email, requested service, preferred location or team and the details you provide to answer your enquiry and prepare a proposal. The selected location identifies the company handling the enquiry, including gifts. For catering at your venue, no shop location is required: Chicha Exports S.A.C. handles these enquiries through the administration email below. Depending on the service, you may provide the date, number of guests or gifts, event location and food preferences. If you provide a phone number, we may use it to coordinate with you. Fields marked * are required to process an enquiry through this form; your phone number and additional message are optional. The enquiry is sent to Francis@gaybakerlima.com. Sending an enquiry does not subscribe you to the newsletter or confirm a booking.
4. Kit and international processing
Our email list is managed using Kit, Inc. (formerly ConvertKit), our email-service/data-processing provider. Subscriber data is processed outside Peru, including in the United States and by Kit’s subprocessors. Chicha Exports S.A.C.’s registered data bank includes the international communication declared for this service. Kit publishes its Data Processing Addendum and Privacy Policy.
Kit manages your subscription status and sends you an email to confirm that you wish to subscribe.
5. Cookies, local storage and analytics
The necessary tgb_cookie_consent cookie remembers your privacy choices for up to 180 days. The functional tgb_newsletter_dismissed preference is saved in your browser when you close the newsletter and used for seven days; it is removed when you next visit after that period. The private staff area uses a necessary session cookie to keep the relevant location signed in.
Google Analytics 4 or Google Tag Manager does not load until you accept Analytics. Rejecting analytics does not prevent you from using the website, making enquiries or joining the email list. If accepted, analytics helps us understand visits and conversions such as WhatsApp, Whole Cake, Afternoon Tea and corporate enquiries.
This version does not install Meta, TikTok or other advertising pixels. If that changes, we will update the notice and request the relevant preference before activation. You can change your choice at any time through in the footer.
If you accept analytics, Google Analytics may use _ga and _ga_… cookies to distinguish visits and sessions, configured for up to 180 days. Google may process this data outside Peru; see Google’s Privacy Policy. You can withdraw consent through Cookie settings; subsequent analytics collection is disabled and analytics cookies accessible to this website are removed.
6. WhatsApp, maps and social media
When you follow a link to WhatsApp, Google Maps, Instagram, TikTok, Facebook or another external service, that provider’s privacy terms also apply. Some links use a pre-filled message to identify the product, service or location that prompted the enquiry.
7. Libro de Reclamaciones
The online Libro form emails the complaint record to The Gay Baker and sends a copy to the consumer. It is not kept as a WordPress form entry. Complaint records and evidence of the response must be retained for at least two years from the date the complaint is filed.
8. Retention and security
We keep data as long as needed for its purpose and for legal, accounting or rights-protection obligations. Email-list information is kept while you remain subscribed, with minimum records retained where needed to honour opt-outs, evidence consent or prevent duplicate use of a promotion. We use reasonable access, minimisation and security measures.
9. Your rights and contact
You can request information about your data, access, correction, cancellation or deletion, and object to its processing. You can also withdraw consent and exercise other rights recognised under Peruvian law. Write to info@thegaybakershop.com, explaining your request and the relevant location or service. We will let you know if we need further information to verify your identity or process the request. We will handle it within the applicable legal requirements and deadlines.
10. Legal framework
This policy is based on Peru’s Law No. 29733 and its Regulation approved by Supreme Decree No. 016-2024-JUS, in force since 31 March 2025, together with applicable consumer and data-protection rules.
